HOA and Condo Law in Palm Beach County

Palm Beach County has one of the highest concentrations of community associations in Florida. Disputes between residents and boards are common, costly, and personal in a way most business disputes are not.

The rules have changed four times since 2022. Milestone inspections were created by SB 4-D in May 2022, after the Champlain Towers South collapse, and are codified at Section 553.899, Florida Statutes. HB 913 took effect July 1, 2025 and reworked the financial side. It moved the structural integrity reserve study deadline to December 31, 2025, raised the reserve item threshold from $10,000 to $25,000, allowed reserves to be funded through loans or lines of credit with proper approval, and let associations that recently completed a milestone inspection pause or reduce certain reserve contributions to pay for the repairs that inspection identified. Associations are also now required to maintain an account with the Division of Condominiums, Timeshares and Mobile Homes. Board members who mishandle any of this can be exposed personally.

Florida law treats condominiums and homeowners associations differently. Condominiums are governed by Chapter 718 of the Florida Statutes, while HOAs are governed by Chapter 720. The rules, rights, and procedures are distinct. You need an attorney who understands the difference.
